PRIVACY NOTICE FOR EDAG MEXICO SA. DE C.V.  JOB APPLICANTS

EDAG México S.A. de C.V. (hereinafter “Edag” or “the company") is responsible for the treatment of the personal data provided by the "candidate" at the beginning, during and at the end of the selection process in which he/she participates. Your personal data will be protected in accordance with the provisions of the General Law for the Protection of Personal Data held by private Parties, and other applicable regulations, hereinafter “the Law”. The address of the responsible is located at Avenida Ébano Lote A, interior 10, Parque Industrial Finsa, San Lorenzo Almecatla, C.P. 72710, Cuautlancingo, Puebla, México.

I. Purposes of the processing of Personal Data

The personal data collected from you will be used exclusively for the following purposes:

Primary Purposes

  1. To fully identify the candidate to fill a job position.
  2. To contact you, conduct interviews, verify that you have the skills and aptitudes in accordance with the profile requirements for the job to be performed, as well as to inform you about the recruitment and selection process.
  3. To know and validate your academic and work history.
  4. To know your immigration status (in the case of foreigners).
  5. To carry out the corresponding internal procedures in case of an eventual hiring.
  6. To know your physical condition, in order to know if you require special attention in case of any eventuality, to provide health care, or for the management of health services.
  7. To comply with requirements that the competent authority requests, and which the company is obliged.
  8. To give attention to requests for the exercise of ARCO rights and access to information.

Secondary Purposes

In addition, the company will use your personal information for the following purposes that are not necessary, but that allow us to improve our human resources processes: 

  1. To perform statistics and historical record of prospects.
  2. To send you advertising about other vacancies that may exist in the company.

II.Personal data processed

In order to carry out the purposes described above, EDAG will use the following personal data:

  1. Identification data: name; marital status; autographic signature; Federal Taxpayers Registry (RFC); Unique Population Registry Code (CURP); place and date of birth; nationality; photograph; age.
  2. Contact information: address, e-mail, telephone, cell phone.
  3. Employment data: previous positions held, employment references; previous work address, institutional e-mail and institutional telephone number of your employment references; date of entry and exit from employment, among others.
  4. Academic data: educational background, degrees, professional credentials, certificates, awards, among others.

In addition to the personal data mentioned above, the company will use the following personal data considered as sensitive, which require special protection, such as:

  1. data on union membership. A person's membership in a trade union and the information derived from it (in some cases).
  2. Health data. Information related to the assessment, preservation, care, improvement and recovery of their physical or mental health, present, past or future.

III.Transfer of data.

We inform you that the personal data obtained from those persons who participate in a selection process may be transferred to the following companies EDAG Engineering GmbH y EDAG Beteiligung GmbH only when it is strictly indispensable to carry out the primary purposes indicated in this notice. The aforementioned companies are domiciled in the Federal Republic of Germany and belong to the same corporate group as the responsible company, and therefore operate under the same internal processes and policies. Due to the above, based on article 37 of the Federal Law for the Protection of Personal Data in Possession of Individuals, we do not require your consent to transfer your personal data to the aforementioned companies.

We inform you that, for the fulfillment of the purposes expressed above and without prejudice to the exceptions contained in article 10 of the Law, the personal data in possession of EDAG could be transferred and processed by third parties, which are listed below:

  1. Companies that practice psychometric, socioeconomic and integrity studies;
  2. Companies or providers of occupational medicine services.

We also inform you that the personal data you provide us may be transferred to the authorities that request it, provided that such request is issued by a competent authority, and is duly founded and motivated.

IV. Means to exercise the rights of access, rectification,cancellation or opposition to the processing of personal data (ARCO Rights).

You have the right to know what personal information we have about you, what we use it for and the conditions of the use we make of it (Access). In addition, you may request the correction of your personal information in case it is outdated, inaccurate or incomplete (Rectification); that we remove it from our records or databases when you consider that it is not being used in accordance with the principles, duties and obligations provided in the regulations (Cancellation); as well as oppose the use of your personal data for specific purposes (Opposition). These rights are known as ARCO rights.

For the exercise of any of the ARCO rights, or for any doubt, complaint or suggestion regarding the use of your personal data, you may submit the respective request to the Data Protection Department through the following e-mail address [email protected]

The exercise of ARCO rights shall be subject to the following procedure:

  1. Any request for the exercise of ARCO rights shall contain the following:
  • Name of the holder of the personal data.
  • Copy of the document proving the identity of the owner, which may be a voter's credential, professional ID card, passport, military ID card or credential issued by INAPAM (National Institute for the elderly).
  • In the event that the holder carries out the procedure through a representative, he/she must show the document that proves the legal representation of the holder, which may be a simple Power of Attorney granted before two witnesses, which must be accompanied by copies of the identification of the holder, the representative and the witnesses. Only the identifications indicated in paragraph b of this section will be accepted.
  • Address or any other means for receiving replies to your request.
  • Clear and precise description of the personal data with respect to which you are seeking to exercise any of the aforementioned rights.
  • Description of the right to be exercised.
  • If applicable, documents or information that facilitate the location of the personal data.

        2. Additionally, depending on the right you wish to exercise, you must indicate the following:

  • For the right of Access: The form in which you wish the information to be delivered to you, which may be in person at the facilities of EDAG through e-mail or by parcel. Likewise, you must indicate whether you want the information to be provided in simple or certified copy.
  • For the right of rectification: the modifications you request to be made to your personal data, for which you may provide the documents supporting the request.
  •  Right of Cancellation: the causes for which you request the deletion of your personal data from the files, records or databases of EDAG.
  • Right of Opposition: the reasons for which you request the termination of the processing of your personal data, or if applicable, you must indicate the specific purposes for which you wish to exercise this right.

        3. If the request does not contain the information described above, EDAG may request, within a maximum period of 5 days from the day following the filing of the request, the missing information and the applicant will have 10 working days to provide the required information. If the requirements are not fulfilled, the request will be considered as not submitted.

        4. Once the request has been submitted, and provided that it complies with the requirements described above, the area responsible for the processing of personal data shall inform you whether or not the exercise of the requested right proceeds, within 20 business days, counted from the day following receipt of the request, or from the date on which the requirement formulated has been complied with. This term may be extended for up to 10 more working days, when there are justified causes.

        5. If the request is favorable, EDAG will have a period of 15 days from the next day in which the response has been notified, to take the necessary actions to enforce it.

The exercise of ARCO rights is completely free of charge. Regarding the delivery of personal data, this will be free of charge too and the holder will only have to cover the shipping costs, or the costs of reproduction in copies or other formats.

V. Choices and means to limit the use or disclosure of personal data

In the event that you have given your consent for the secondary purpose identified with number 2 of this Notice, consisting of "Sending you advertising about other vacancies that may exist in the company", we inform you that you may limit the use and disclosure of your personal information in order not to receive communications or promotions from the responsible party. To do so, please send a request to the e-mail [email protected] indicating that you wish to limit the use and disclosure of your information.

VI. Revocation of consent for the processing of your personal data.

You may revoke the consent you have given to EDAG for the processing of your personal data. However, it is important that you consider that not in all cases we will be able to meet your request or terminate the use immediately, since it is possible that for some legal obligation we require to continue processing your personal data or because it is necessary to satisfy the purpose for which it was handled.

Likewise, you should consider that, for the main purposes indicated in this Notice, the revocation of your consent will imply the conclusion of your participation in the selection process.

To revoke your consent, you must send your request to the email [email protected] with the requirements indicated in numeral 1 of the chapter "Means to exercise the rights of access, rectification, cancellation or opposition for the processing of personal data (ARCO Rights)". The resolution deadlines will be the same as those indicated in numerals 3, 4 and 5 of the same chapter.

If you have any doubts or comments, you may contact the Data Protection Department through the email address [email protected], who will process your request and answer any questions you may have regarding the revocation of consent.

VII. Notification of Personal Data Security Breaches

In the event of a personal data security breach, EDAG will notify the Federal Institute for Access to Information and Data Protection, no later than 72 hours after it becomes aware of the breach. Likewise, it will inform you of such situation, indicating the authority that was notified of the personal data security breach, the possible consequences and the measures taken by the responsible party to safeguard the information.

VIII. Time periods for the conservation of personal data

The personal data collected in terms of this privacy notice will only be kept while the candidate's selection process remains in force. Once the process is over, your personal information will be kept by the company for a period of five years.

Once the indicated terms have elapsed, the company will proceed to the cancellation of the data it has kept, after blocking them, for their subsequent deletion.

IX. Changes to this Privacy Notice

This privacy notice may undergo modifications, changes or updates derived from new legal requirements; from the company's own needs; from our privacy practices; from changes in our business model, or for other reasons.
